When the defendant physician ended his employment with the center and began to work for a physician's practice center less than one mile away which also provides general and family medicine, ambulatory care, and general internal medicine, the plaintiff commenced this action. After the proprietor of the family care center died, his wife - who is not licensed to practice medicine - continued to administer its operation. The center hired the defendant physician under an employment agreement with a non-competition provision barring him upon termination from practicing medicine within 20 miles of the care center for a three-year period, and fixing a $10,000 per month liquidated damage provision for violation of the restriction. A family care center operated by a doctor provided general medical practice, family medicine, ambulatory care and internal medicine in a Virginia community.
